This is a class action lawsuit on behalf of those who purchased or acquired Hyzon Motors Inc. (“Hyzon”) (NASDAQ: HYZN; HYANW) f/k/a Decarbonization Plus Acquisition Corporation (NASDAQ: DCRB; DCRBU; DCRBW) securities between January 23, 2021 and September 27, 2021, both dates inclusive (the “Class Period”).
The Complaint alleges that throughout the Class Period, the Defendants made false and/or misleading statements and/or failed to disclose that: (1) Hyzon was misrepresenting the nature of its “customer” contracts and severely embellished its “deals” and “partnerships” with customers; (2) Hyzon could not deliver its announced vehicles in 2021, on its stated timeline; and (3) as a result, the defendants’ public statements were materially false and/or misleading at all relevant times.
Current Status of Case:
On September 13, 2023, Defendants filed a Motion to Dismiss the action. That Motion has been fully briefed and is pending decision by the Court. On February 7, 2025, this case was reassigned to the Honorable Meredith Vacca. This action is ongoing.
