Case Background:
On February 1, 2017, the initial complaint in this securities class action was filed against DaVita, Inc. (“DaVita” or the “Company”), and certain of Davita’s directors and officers, asserting violations of Sections 10(b) and 20(a) of the Securities Exchange Act. This is a federal securities class action brought on behalf of all persons who purchased or otherwise acquired DaVita common stock during the period between February 26, 2015 and October 6, 2017, (the “Class Period”) both dates inclusive, and were damaged thereby.
The complaint alleged that DaVita’s press releases, investor presentations, and public filings made with the SEC included material misstatements and/or omissions concerning the Company’s financial results, which included revenue derived from insurance plans in which DaVita, through the American Kidney Fund, was improperly paying for patients’ health care premiums.
Current Status of Case:
On July 19, 2020, the parties agreed to settle this action. On October 27, 2020, the Court preliminarily approved the Settlement. On August 9, 2021, the Court granted Lead Plaintiffs’ Motion for Final Approval of the Settlement in the amount of $135,000,000.00. This action has concluded.
