Kessler Topaz Meltzer & Check, LLP announces that it has filed a class action lawsuit against Gerber Products Company (“Gerber”) and Nestlé Holdings, Inc. for their deceptive, fraudulent and unlawful conduct with respect to the manufacture, marketing and sale of Gerber baby food products. The case is filed in the United States District Court for the Eastern District of Virginia, Alexandria Division and is captioned Pipes v. Gerber Products Company, et al., (the “Action”). The Action is filed on behalf of all consumers who purchased Gerber’s baby food products from 2017 through present.
On February 4, 2021, the U.S. House of Representatives Subcommittee on Economic and Consumer Policy Committee on Oversight and Reform issued a Staff Report which found that “commercial baby foods are tainted with significant levels of toxic heavy metals, including arsenic, lead, cadmium, and mercury.”
Kessler Topaz Meltzer & Check, LLP continues to investigate whether the baby food manufacturers listed below knowingly sold unsafe baby products:
• Nurture, Inc. (Nurture), which sells Happy Family Organics, including baby food products under the brand name HappyBABY
• Beech-Nut Nutrition Company (Beech-Nut)
• Hain Celestial Group, Inc. (Hain), which sells baby food products under the brand name Earth’s Best Organic
• Gerber
• Campbell Soup Company (Campbell), which sells baby food products under the brand name Plum Organics
• Walmart Inc. (Walmart), which sells baby food products through its private brand Parent’s Choice
• Sprout Foods, Inc. (Sprout Organic Foods)
The Subcommittee further reported that it had "grave concerns about baby food products manufactured by Walmart (Parent’s Choice), Sprout Organic Foods, and Campbell (Plum Organics). These companies refused to cooperate with the Subcommittee’s investigation. The Subcommittee is greatly concerned that their lack of cooperation might obscure the presence of even higher levels of toxic heavy metals in their baby food products, compared to their competitors’ products.”
