TikTok Privacy Class Action

Kessler Topaz filed a Class Action Complaint against TikTok Inc. f/k/a Musical.ly, Inc. and ByteDance Inc. for unlawfully tracking and collecting personal data without the user’s knowledge or consent.

Specifically, the Complaint alleges that TikTok has secretly amassed massive amounts of highly invasive information about its users by tracking their activities on third-party websites. In doing so, TikTok unlawfully intercepted private and personally identifiable data and content from unwitting TikTok users to generate massive revenues by selling and providing access to this data. Through their clandestine tracking activities, TikTok has violated wiretap laws, unlawfully intruded upon users’ privacy, violated their rights of privacy, and unjustly profited from these unlawful activities.

Kessler Topaz is concerned that, while using the TikTok app, TikTok users may have unwittingly clicked on links to external third-party websites and purchased merchandise after viewing advertisements in the app while TikTok unlawfully collected data associated with the use of third-party websites without the user’s knowledge or consent.
