Case Background:
A class action lawsuit was filed on behalf of those who purchased or otherwise acquired Zynex, Inc. (“Zynex”) (NASDAQ: ZYXI) securities between March 13, 2023, and March 11, 2025, inclusive (the “Class Period”).
The complaint alleges that, throughout the Class Period, Defendants made materially false and/or misleading statements, as well as failed to disclose material facts about the company’s business, operations, and prospects. Specifically, Defendants misrepresented and/or failed to disclose that: (1) Zynex shipped products, including electrodes, in excess of need, causing it to report inflated revenues; (2) Zynex had a practice of filing false claims, which drew scrutiny from insurers such as Tricare, and, as a consequence, it was reasonably likely that Zynex would face adverse impacts, including removal from insurer networks and penalties from the federal government; and (3) as a result of the foregoing, Defendants’ statements about the company’s business, operations, and prospects were materially false and misleading and/or lacked a reasonable basis at all relevant times.
What is a Lead Plaintiff?
A lead plaintiff is a representative party that acts on behalf of other class members in directing the litigation. In order to be appointed lead plaintiff, the Court must determine that the class member’s claim is typical of the claims of other class members, and that the class member will adequately represent the class.
