Honda and Acura Defective Stop Start Class Action

On January 9, 2023, Kessler Topaz filed a Class Action Complaint against Honda Motor Co., Ltd. and American Honda Motor Co., Inc. in connection with a defect in the engines of certain vehicles Defendants manufactured as listed below. These vehicles are all equipped with an Auto-Idle Stop (“AIS”) system that is designed to improve fuel efficiency.  However, this defect causes the AIS system to fail to trigger an automatic engine restart when the driver releases the brake pedal, with the AIS feature engaged. When this occurs, the vehicle will, suddenly and without warning, become inoperable and immobile. This defect poses significant safety risks to the drivers and passengers of these vehicles because when the AIS system fails to restart the engine, the vehicle becomes inoperable and immobile, often in hazardous locations. 

The complaint asserts claims against Defendants for: (1) fraud by omission/fraudulent concealment; (2) negligent misrepresentation; (3) unjust enrichment; (4) breach of express and implied warranties; and (5) other violations.The affected vehicles include those listed below which were equipped with a 3.5L engine as well as a 9-speed automatic transmission.
