Kessler Topaz is investigating potential antitrust claims against Google for its anticompetitive conduct related to online display advertising.
Specifically, Kessler Topaz is investigating whether Google manipulated ad exchanges (electronic platforms where auctions for ads take place, theoretically awarding available ad space to the highest bidder) to acquire and maintain a monopoly in the display advertising marketplace. This alleged manipulation included: (1) Google’s use of a “last look” policy that permitted advertisers on Google platforms to have the last opportunity to outbid the highest bidder (and otherwise favoring bids from advertisers on Google platforms); (2) the imposition of surcharges on bids from non-Google platforms; and (3) the enactment of policies which inhibit the use non-Google ad platforms.
As a result of Google’s alleged conduct, publishers (websites that generate revenue by selling ad space) received lower prices for their ad space, and thus earned less ad revenue, and advertisers (those who bought space to display their advertisements) were subject to increased advertising costs.
