Kessler Topaz has filed a class action complaint against General Motors LLC (“GM”) related to faulty transmissions in certain (2019-2022) Cadillac, Chevrolet, and GMC vehicles. Specifically, the complaint alleges that a potential defect in GM 8-speed transmission models 8L90 and 8L45 in the vehicles listed below, may cause, among other things, hesitation, shaking, shuddering, kicking, lurching, jerking, unpredictable acceleration, weak acceleration, rough idle, and bucking, particularly when the vehicle changes gears or engages from a stop (either at a light, or when switching from park to drive, or drive to reverse, etc.). As we allege in the complaint, “[t]he jerking, hesitation, surging, and lurching present a safety hazard because they affect the driver’s ability to control the vehicle’s speed, acceleration, and deceleration.”
In addition, individuals who brought these affected vehicles to a GM dealership may have had their transmission fluid or torque converter replaced or may have been told that the transmission needs to have its computer reset or needs to “learn” how they drive.
