Kessler Topaz is currently litigating a class action case against General Motors LLC (“GM”) related to defective and faulty transmissions in certain (2015-2019) Cadillac, Chevrolet, and GMC vehicles. Please be advised that, based on a recent decision by the Sixth Circuit Court of Appeals, this action now only alleges claims on behalf of individuals who purchased the vehicles below from the following states: Florida, Kansas, Kentucky, Louisiana, Tennessee, and Washington. If you purchased one of the vehicles below from any other state, you are not part of the putative class in this case.
The action alleges that a potential defect in GM 8-speed transmission models 8L90 and 8L45 cause, among other things, hesitation, shaking, shuddering, kicking, lurching, jerking, unpredictable acceleration, weak acceleration, rough idle, and bucking, particularly when the vehicle changes gears or engages from a stop (either at a light, or when switching from park to drive, or drive to reverse, etc.). In addition, individuals who brought one of these vehicles to a GM dealership may have had their transmission fluid or torque converter replaced or may have been told by their dealership that the transmission needs to have its computer reset or that it needs to “learn” their driving habits.
