Kessler Topaz Meltzer & Check, LLP Investigates Potential Class Action Against Flo Health, Inc. For Improper Data Sharing
Kessler Topaz Meltzer & Check, LLP (“Kessler Topaz”) is investigating a potential class action lawsuit against Flo Health, Inc. (“Flo Health”), the developer of the Flo Period & Ovulation Tracker (“Flo App”), for sharing health information of users without consent and after promising that the information would be kept private.
About Flo Health and Flo App
Flo Health developed, advertised, offered for sale, sold, and distributed the Flo App, a mobile application powered by artificial intelligence that functions as an ovulation calendar, period tracker, and pregnancy guide. Flo App is used by more than 100 million women.
Kessler Topaz’s Investigation
Kessler Topaz is investigating reports that Flo Health disclosed sensitive health information through use of the Flo App, such as the fact of a user’s pregnancy, to third parties in the form of “app events,” which is app data transferred to third parties for various reasons. In addition, Flo Health did not limit how third parties could use this health data nor did it not stop disclosing this sensitive data until its practices were revealed in a news article in February 2019, which prompted hundreds of complaints from the app’s users. In a complaint filed against Flo Health, the Federal Trade Commission (“FTC”) has alleged that the company shared the health information of users with outside data analytics providers after promising that such information would be kept private. The FTC recently settled these charges against Flo Health for misleading users concerning their privacy.
