Dodge Ram General Motors Roof Rail Defective Airbag

Kessler Topaz has filed a consumer class action lawsuit against FCA US LLC (“FCA”), General Motors Corp. (“GMC”), and Key Safety Systems, Inc. d/b/a Joyson Safety Systems (“Joyson”), related to potential safety issues involving the roof-rail airbag systems in certain Dodge, Chevrolet, and GM vehicles. The lawsuit has been filed in the United States District Court for the District of New Jersey, Civil No. 21-cv-15867.

Allegations in the complaint concern potentially defective airbags manufactured by Joyson, the successor-in-interest to Takata Corporation. These airbags contain inflator defects (corrosion and embrittlement in the inflator), which may have been contaminated by moisture during Joyson’s manufacturing process, and equipped in the trucks listed below. The complaint alleges that the Joyson airbags fail to perform as they should. Instead of protecting vehicle occupants from bodily injury during accidents, the defective Joyson airbags may spontaneously explode and may injure drivers and passengers. As of August 2021, Joyson airbags have been involved in three recalls because of the inflator defect.
