Remeron: Consumers allege patent claims would create unlawful monopoly

Served as co-lead counsel in an action alleging that Organon, Inc. (Organon) violated state and federal antitrust laws in an effort to extend its monopoly on the antidepressant Remeron.

On behalf of consumers and third party payors, we claimed that Organon’s filing of certain patents and patent infringement lawsuits constituted an unlawful effort to keep competing products off the market. After lengthy litigation, including numerous motions and more than 50 depositions, the matter settled for $36 million.
