Thank you for contacting Kessler Topaz regarding the class action lawsuit (the “Action”) against Mazda Motor of America, Inc. d/b/a Mazda North American Operations and Mazda Motor Corporation (collectively “Mazda”), which was filed in 2019.
In February 2023, the District Court issued an order granting summary judgment in Mazda’s favor and entered judgment for Mazda. The effect of entering judgment for Mazda was that the case ended before a trial. We appealed this decision to the Ninth Circuit Court of Appeals.
Unfortunately, the Ninth Circuit Court of Appeals entered an order which approved the District Court’s dismissal of the Action. Thus, there was no recovery achieved for the putative class in connection with the dismissal and this Action has concluded.
